Terms & Conditions for the use of Electric Vehicle (EV) Charging Unit
Definitions

“Charging Unit” –  the EV charging unit that is located at Penlan Villa and that is suitable for charging an EV
“EV”  – a motor vehicle registered for use on public roads whose main source of power is electricity stored in an on-board battery or batteries (including hybrid models)
“Owners” – Richard & Theresa Cresswell
“Terms and Conditions” – the terms and conditions stated in this document, as may be updated from time to time.
“The Lodge Website” – https://thelodge.penlanvilla.com
“You” – the guest or guests staying at The Lodge

Agreement

By using the Charging Unit You acknowledge that You have read and understood these Terms and Conditions, and that You agree to be bound by them.

If You do not agree to be bound by these Terms and Conditions, You must not use the Charging Unit

What You agree to do

The driver’s handbook for your EV describes how to recharge your EV safely and efficiently, and You agree to take all reasonable efforts to recharge your EV in accordance with the guidelines in the driver’s handbook.

You agree to provide your own charging cable. A charging cable will not be provided by Owners.

Your use of the Charging Unit must be fair and reasonable and must not be excessive. You agree that, if Owners consider that your usage is unfair, unreasonable or excessive, we may immediately suspend, modify or restrict your access to the Charging Unit.

The applicable kW per hour rate will be provided to You prior to using the Charging Unit. You agree to pay the full amount notified by the Owners.

You agree not to use the Charging Unit in a way that will put the Charging Unit, You, any other person, your EV or any other person’s vehicle at unnecessary risk.

You acknowledge that the Charging Unit will not be supervised and that You will use it at your own risk.

You acknowledge that there may be times where the Owners will impose a limit on the time an EV can be charged for. The Owners have the right to disconnect a charging EV to allow access for another user, this will only be done after what is deemed to be a fair and reasonable time.

In the case of an emergency the Owners can remotely stop charging sessions on the grounds of safety.

If there are any faults or You have any issues with the Charging Unit, please contact the Owners.

Your liability to The Owners

You may be liable to the Owners as a result of any direct loss or damage that the Owners or the Charging Unit may suffer as a result of You using or having used the Charging Unit negligently.

What The Owners agree to do

The Owners will provide the Charging Unit to enable you to recharge your EV. In doing so, we may suspend or refuse access to the Charging Unit at any time, for any reason.

The Owners will endeavour to keep the Charging Unit free from any faults, errors or defects but the Owners do not guarantee, nor accepts any obligation to ensure the availability, compatibility, or performance of the Charging Unit, nor are we able to guarantee an uninterrupted supply of electricity to the Charging Unit.

The Owners will take reasonably practicable steps to ensure that the instructions about how to use the Charging Station are as clear as the Owners can practicably make them.

Governing law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales and will be subject to the exclusive jurisdiction of the courts of England and Wales.
